About These Terms

These Website Terms and Conditions (“Terms”) govern access to and use of the website operated by Dabisa Consulting (Pty) Ltd (“Dabisa”, “we”, “us” or “our”).

By accessing or using the website, submitting a form or downloading a resource, you agree to these Terms.

If you do not agree, you should discontinue use of the website.

About Dabisa

Dabisa provides BIM compliance, asset-readiness, information-management and built-environment data services, which may include:

  • BIM compliance audits;

  • compliance-readiness assessments;

  • model and data validation;

  • BIM data population;

  • legacy drawing activation;

  • compliance reporting dashboards;

  • asset-register preparation;

  • BIM workflow standards;

  • Information Delivery Specifications;

  • Employer’s Information Requirements;

  • facilities-management data preparation; and

  • related advisory, reporting and technical services.

No Client Relationship Created Through the Website

Dabisa’s assessments and validation services may compare supplied information against defined rules, client requirements, classification systems, data fields or published standards.

Any output depends on factors including:

  • the completeness and accuracy of information supplied;

  • the model version and file format;

  • the project stage;

  • the agreed scope;

  • software compatibility;

  • the ruleset or Information Delivery Specification used;

  • the interpretation and version of the referenced requirement;

  • assumptions communicated to the client; and

  • matters outside the model or dataset.

A model or dataset passing a Dabisa validation rule does not necessarily mean that:

  • the physical asset is correctly designed or constructed;

  • the project complies with every applicable law;

  • all engineering calculations are correct;

  • the model is clash-free;

  • the underlying source information is accurate;

  • a regulator or client will accept the submission;

  • a professional council has certified the work; or

  • the project is safe or fit for a particular purpose.

Unless expressly agreed otherwise in writing, Dabisa’s outputs identify information and data conditions within the agreed scope and do not replace professional judgement, inspections, statutory approvals or independent verification.

No Professional or Regulatory Advice

The website may refer to ISO 19650, SANS 19650, SANS 10400, COBie, IFC, IDS, Uniclass, OmniClass, Revit, Civil 3D, Power BI and other standards, formats, software or frameworks.

These names and materials may be owned by their respective standards organisations, publishers or technology providers.

References are descriptive and do not imply that:

  • Dabisa owns the relevant standard or software;

  • the standards body has endorsed Dabisa;

  • Dabisa is an official certification body;

  • Dabisa is accredited by the relevant organisation; or

  • the full text of a third-party standard may be copied or distributed through the website.

Users remain responsible for obtaining properly licensed copies of applicable standards and software.

BIM Compliance and Validation Disclaimer

Free or preliminary assessments, readiness scores, checklists and website tools are indicative only.

They are intended to:

  • help users identify potential information-management gaps;

  • support an initial conversation;

  • provide general educational guidance; or

  • assist Dabisa in understanding a prospective engagement.

They are not a comprehensive audit, binding finding, professional opinion or guarantee of compliance.

A score or website response does not constitute a quotation or commitment to achieve a particular outcome.

References to Standards and Third-Party Frameworks

We aim to keep website information reasonably accurate and current, but we do not guarantee that every page will always be complete, error-free or current.

Standards, software, legal requirements and industry practices may change. Website content may also be simplified for general communication.

Users should confirm important information directly with Dabisa before relying on it.

We may correct, withdraw or update content without prior notice.

Assessments, Scores and Checklists

You warrant that information submitted through the website is:

  • accurate to the best of your knowledge;

  • not misleading;

  • lawfully obtained;

  • not in breach of another person’s confidentiality, privacy or intellectual-property rights.

You must not submit unlawful, malicious, defamatory or harmful content.

Accuracy of Website Information

General website forms are not intended for the submission of confidential BIM models, detailed infrastructure layouts, security plans, personal information databases or sensitive project documents.

Do not submit these materials unless Dabisa has:

  • specifically requested them;

  • provided an approved transfer method; and

  • agreed any necessary confidentiality or data-processing arrangements.

Submitting information through a general enquiry form does not, by itself, create a non-disclosure agreement.

Where Dabisa invites a file submission, the submitting party remains responsible for:

  • having authority to disclose it;

  • removing unnecessary personal information;

  • maintaining its own backup;

  • checking files for malware;

  • identifying confidentiality classifications; and

  • complying with project, security and export restrictions.

Submitting Information

You retain ownership of information and files you submit.

You grant Dabisa a limited, non-exclusive right to receive, copy, store, analyse and otherwise process submitted information only to:

  • respond to the request;

  • prepare an assessment, proposal or quotation;

  • deliver agreed services;

  • maintain security and backups;

  • comply with legal obligations; and

  • exercise or defend legal rights.

Any broader use of identifiable client material must be authorised by the relevant agreement or by written consent.

Confidential and Security-Sensitive Project Information

Unless otherwise indicated, the website and its original content-including text, graphics, branding, page layouts, reports, illustrations, methodologies, rules, software components, templates and downloadable resources-are owned by or licensed to Dabisa and are protected by applicable intellectual-property laws.

Dabisa grants users a limited, revocable, non-transferable licence to access the website for legitimate personal or internal business use.

You may not, without prior written permission:

  • reproduce substantial parts of the website;

  • commercially redistribute Dabisa resources;

  • remove copyright or proprietary notices;

  • present Dabisa content as your own;

  • reverse engineer proprietary website functionality;

  • extract or replicate Dabisa’s rules, methodologies or databases;

  • use automated tools to scrape substantial website content;

  • use Dabisa content to train a commercial artificial-intelligence model;

Reasonable quotations may be used where permitted by law and accompanied by appropriate attribution.

Licence to Process Submitted Information

You may link to a public website page provided that the link:

  • is lawful and fair;

  • does not misrepresent your relationship with Dabisa;

  • does not imply endorsement;

  • does not frame or obscure the website; and

  • does not appear on a website containing unlawful or materially misleading content.

We may request removal of a link that creates confusion, legal risk or reputational harm.

Intellectual Property

You must not:

  • interfere with the operation or security of the website;

  • attempt unauthorised access;

  • introduce malware or harmful code;

  • overload, probe or scan the website without permission;

  • impersonate another person;

  • submit false or fraudulent requests;

We do not guarantee that the website will always be available, uninterrupted, secure or free from errors.

To the maximum extent permitted by applicable law, Dabisa will not be liable for indirect, incidental, special or consequential loss arising solely from use of or inability to use the public website.

Dabisa is not responsible for decisions made solely on the basis of general website information or a free preliminary assessment.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct or gross negligence where applicable.

Liability arising from paid professional services will be governed by the relevant signed client agreement.

Disclaimer of Warranties

To the extent permitted by law, you agree to be responsible for loss, claims or reasonable costs resulting from:

  • your unlawful use of the website;

  • information you submit without authority;

  • your infringement of intellectual-property or privacy rights;

  • malware knowingly introduced by you; or

  • your material breach of these Terms.

This section does not require a consumer to waive rights that cannot lawfully be waived.

 Limitation of Liability

Nothing in these Terms is intended to exclude or restrict rights available under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or another applicable law.

Any exclusion, limitation or disclaimer must be interpreted only to the extent permitted by law.

Where a provision is prohibited or unenforceable against a particular user, the remaining provisions will continue to apply.

Indemnity for Misuse

We may update the website and these Terms from time to time.

Where a material change affects an existing contractual relationship, the applicable client agreement and law will determine whether additional notice or agreement is required.

Consumer Rights

These Terms are governed by the laws of the Republic of South Africa.

Before starting formal proceedings, a party should provide written notice of the dispute and allow the other party a reasonable opportunity to address it.

Subject to mandatory consumer rights and jurisdictional rules, disputes relating solely to the website will fall under the jurisdiction of the competent South African courts, including the courts with jurisdiction in KwaZulu-Natal.

Nothing prevents either party from seeking urgent interim relief.

Electronic Communications and Company Information

Notices

General

Unless expressly stated in a signed client agreement, website content does not constitute:

  • engineering advice;

  • architectural advice;

  • legal or regulatory advice;

  • health-and-safety advice;

  • facilities-management advice specific to a particular asset;

  • a statutory compliance certificate;

  • professional certification;

  • approval by a municipality or public authority;

  • approval by a standards body;

  • a professional sign-off; or

  • a substitute for review by appropriately qualified professionals.

Users must obtain project-specific advice and independently evaluate information before relying on it for design, construction, procurement, regulatory, safety, operational or investment decisions.

Accessing the website, completing a form, sending an email, requesting an assessment or downloading a resource does not automatically:

  • appoint Dabisa;

  • create a client-consultant relationship;

  • create a professional duty of care;

  • create a confidential relationship;

  • constitute acceptance of a project;

  • constitute a binding quotation; or

  • oblige Dabisa to provide services.

A professional engagement will only arise when the relevant parties enter into a written proposal, appointment, contract, statement of work or other agreement accepted by authorised representatives.

Where there is a conflict between these Terms and a signed client agreement, the signed client agreement will govern the relevant professional services.

If any provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remainder will continue in effect.

A failure to enforce a provision does not constitute a waiver.

These Terms constitute the agreement governing use of the public website, but do not replace a signed agreement governing professional services.
